Dan Hartzog, Jr. obtained dismissal of all claims in a federal lawsuit filed by a former police officer for a Town. Plaintiff alleged that a recently elected Board member used racial language toward him while berating his work performance. Plaintiff alleged that the Board member threatened his job, and that the Town Manager assented to the Board member’s threats since the Town Manager said nothing at the meeting. Plaintiff resigned his employment, due to what he alleged was a hostile work environment. Defendant filed a motion to dismiss on the grounds that plaintiff did not allege sufficient facts to establish a claim for forced resignation, and it was granted.
