Russ Racine, Virginia Wooten, and Meredith FitzGibbon obtained Summary Judgment for a North Carolina real estate agent and her employer real estate company. The Complaint alleged that the Plaintiffs purchased a home relying on representations by the agent and her company. The Plaintiffs’ alleged fraudulent misrepresentation, fraudulent concealment, and negligent misrepresentation against our clients. The pleadings and discovery established that our clients fully disclosed to the home buyers the correct information, including disclosure on the disclosure statement. Racine, Wooten, and FitzGibbon filed a motion for summary judgment and persuaded the court that there was no genuine issue of material fact. The court agreed, granted our motion for Summary Judgment, and dismissed all claims against our clients.
