Attorneys Nick Valaoras and Jake Stewart will present Average Weekly Wage. When determining value of a claim, the parties are usually at odds with what the proper average weekly wage and compensation rate could be. The use of a particular average weekly wage or compensation rate could drastically change the value of a claim, so this presentation will help equip adjusters on how to accurately determine the proper average weekly wage.

This webinar will begin with an overview of the statutory authority that defines average weekly wage and how to calculate it. We will go through the facts, holdings, and analysis of some recent cases including, but not limited to, Nay v. Cornerstone Staffing, Wilkins v. Buckner, and Ball v. Bayada. Finally, we are going to discuss the difference between calculating average weekly wage in an injury by accident claim and an asbestos/exposure claim. Oddly enough, the calculations for average weekly wage in an asbestos claim are based on a completely different set of principles and it could be easy for an adjuster to mix up when to use each method of calculation. In this discussion, we will also go through the case law that distinguishes how to calculate average weekly wage in an asbestos claim.
