Now What? Early Trends in NC Extended Benefits Cases (Course ID: 215594)
On June 24, 2011, the Legislature passed the current version of the Workers’ Compensation Act, placing limits on temporary total disability benefits by capping it at 500 weeks. However, certain exceptions apply to the 500-week cap, including if the employee proves a “total loss of wage-earning capacity.”
This webinar will begin with an overview of the statutory authority of whether an employee can receive disability benefits beyond the 500 weeks. We will go through the facts, holdings, and analysis of some recent cases decided by Deputy Commissioners in 2020, as well as a reversal of Deputy Commissioner’s decision by the Full Commission. Finally, we are going to discuss the different interpretations by Deputy Commissioners of what constitutes “total loss of wage-earning capacity.”
