On Sept. 10, Andy Avram and Brad Kline led the “The Long and Winding Road of Occupational Disease Claims” webinar as part of the Cranfill Sumner LLP Webinar Series.
The webinar covered strategies for employers regarding the intricacies of North Carolina General Statute §97-53. This statute enumerates 27 specific occupational diseases, many of which are rare and require expert testimony to establish causation between workplace exposure and illness.
The session also covered the different burdens of proof required for listed versus unlisted conditions, providing valuable insights into how to approach these cases. It also covered the concepts of last injurious exposure under NCGS 97-57 and the importance of timely filing under NCGS 97-58, offering practical strategies for both plaintiffs and defense.
