On August 20, 2024, a Texas federal court ordered that the Federal Trade Commission’s controversial noncompete ban “shall not be enforced.” The court agreed with the U.S. Chamber of Commerce and other challengers that the FTC exceeded its statutory authority in promulgating the ban and that the ban was arbitrary and capricious. Vince discussed the decision, what comes next, and what all of this means for employers (and employees) right now.
