Summary:
The plaintiff, an employee of the defendant company, filed a lawsuit claiming that he was entitled to full worker’s compensation benefits, even though the company was offering him another job that he was able to do. When the plaintiff argued that he could not in fact do the job, CSH defense attorney Jennifer Morris Jones went to the job site herself to investigate what the job would really require the employee to do. Having found that the plaintiff could do the job, Ms. Jones argued at the hearing that the job was suitable and the plaintiff was refusing to take it without justification. The Commission agreed with her and ruled that the plaintiff was not entitled to any benefits because of it.
Result/Implications:
CSH attorney Jones kept her client from having to pay benefits to the employee who would not accept the suitable job offered.
