Summary:
The defendants were a lawyer and his firm who had represented certain credit repair companies in a lawsuit. The plaintiffs filed an unrelated lawsuit accusing the defendants, represented by CSH, of conspiring with those companies to run debt elimination and credit repair scams. The plaintiffs wanted to file a class action suit in federal court for $1 billion in damages against the defendants, accusing them of everything from unjust enrichment to conspiracy to violations of federal racketeering laws.
CSH defense attorney Melody Jolly filed a motion to dismiss, arguing that the plaintiffs had just made blind accusations with no evidence to back them up. The court agreed and dismissed all the claims against our client.
Result/Implications:
Instead of being involved in a very lengthy, complicated, and costly class action lawsuit, CSH attorneys helped our client avoid litigation almost entirely due to strategic use of motions.
