Deedee Gasch, a Partner in Cranfill Sumner LLP’s Wilmington, N.C. office, obtained summary judgment in favor of her client, a coastal gift shop.

The plaintiff alleged a concealed hazard on the premises that she claimed was caused by negligent maintenance and inspection by the owners.  As a result of an incident at the property, the plaintiff claimed she suffered serious and permanent injuries, including a traumatic brain injury, and required cervical spine surgery.  Plaintiff sought multiple million dollars in damages.

Ms. Gasch successfully argued that her client was not on notice of the alleged hazard and that the incident was not foreseeable.  The Court agreed, granting summary judgment and dismissing all claims against her client.  Plaintiff has indicated an intent to appeal the dismissal.
