Dan Hartzog, Jr. obtained summary judgment in a lawsuit filed by a former community college professor who alleged that he could not find work due to alleged statements by his former employer. Plaintiff had entered into a separation agreement with the defendant Community College after being charged with public indecency, which included a non-disparagement clause and an agreement that the reasons for his separation would not be disclosed. Plaintiff alleged that the Community College had violated this agreement, and sued for breach of contract. Following discovery, defendants moved for summary judgment on the grounds that Plaintiff could not establish a violation of the separation agreement, as the information which plaintiff contended was disclosed was also available publicly. The motion was granted, and all claims were dismissed.
