Jeremy Hopkins (Raleigh) successfully defended the owners of a North Carolina paint and body shop in an eminent domain case against the North Carolina Department of Transportation. The NCDOT took .062 acres from the owners’ property and an additional .067 acres in easement. The NCDOT offered the owners $41,775, claiming its taking did not impact the property. Mr. Hopkins secured a jury verdict in the full amount sought by the owners, $433,000. The owners are now entitled to interest on the amount they recovered, and they will be seeking reimbursement for certain costs and expenses as a result of the NCDOT’s actions.
