Highlights:
By thoroughly investigating the facts and uncovering dishonest dealings, CSH attorney Bolick was able to save his client from facing the personal and professional embarrassment of a malpractice suit, as well as from paying money damages he did not owe.
Summary:
CSH’s client, an attorney who specialized in real estate closings, had been accused of paying off the wrong deed during a real estate transaction. The insurance company that had to pay damages because of it brought a malpractice suit against him. CSH defense attorney Ryan D. Bolick went to the Register of Deeds and did some digging. There, he found that the seller had in fact had two deeds on two different properties and had intentionally given the information on the wrong one to the attorney for him to pay off, then transferred that property to someone else. When defense attorney Bolick showed this information to the insurance company who was suing his client, the company saw that the attorney had actually been the victim of fraud, rather than the perpetrator. Based on that information, they dropped their suit against the attorney entirely.
Result/Implications:
Thorough investigation by CSH attorney Bolick uncovered the real facts behind a seller’s dealings and helped his client exit a lawsuit completely.
