Matt Covington (Charlotte) recently obtained an Opinion & Award in favor of Defendants on all issues in a case where the Claimant alleged injuries to the back stemming from an alleged accident at work in May 2013. Medical evidence showed Claimant had a pre-existing chronic back condition. Matt Covington successfully argued the medical evidence was ambiguous and showed no evidence that the alleged incident material exacerbated or aggravated the chronic back condition. The Commission agreed and determined that on the grounds of conflicting factual evidence and equivocal medical testimony that the Claimant had failed to satisfy his burden of proving by a preponderance of the evidence that he sustained a compensable specific traumatic incident.
