Mica Nguyen Worthy, partner in the Charlotte office handling complex commercial disputes, worked diligently for her credit union client to obtain a favorable settlement resolution in a class action lawsuit. The credit union disputed that its Membership Disclosures were in any way unclear on the manner in which overdraft fees would be incurred by members as alleged by the plaintiffs on behalf of several classes. Mica and the legal team first obtained a favorable N.C. Court of Appeals decision that helped limit the scope of plaintiffs’ allegations, and then she worked with experts on evaluation of exposure risks to successfully negotiate a favorable settlement for the credit union, which was approved by the Court.
