Rob Griffin (Raleigh) and a former Cranfill Sumner attorney obtained a Rule 12(b)(6) dismissal of a punitive damages claim in a wrongful death suit in Alamance County Superior Court. The estate of the decedent sought punitive damages from the defendant corporation’s driver, who was legally intoxicated and was also killed in the accident. The dismissal of the punitive damages claim against the defendant estate assisted Rob and his former colleague in obtaining favorable settlements in the wrongful death claim and a companion suit in Guilford County involving a catastrophic injury to the passenger of the other vehicle in the same accident.
