STEPHANIE GASTON POLEY (Raleigh) successfully obtained Summary Judgment for the owner of a hotel in a premises liability case. Plaintiff alleged that she slipped on an area of wet carpet in her hotel room. After deposing Plaintiff as well as Plaintiff’s roommate at the hotel, Defendant moved for Summary Judgment on multiple grounds. Defendant argued that viewing the evidence in the light most favorable to Plaintiff, Plaintiff had at least equal, if not superior, knowledge of the allegedly defective condition of the carpet prior to the accident. As such, Defendant argued it had no duty to warn or protect Plaintiff from the allegedly dangerous condition. After consideration of all matters of record and the arguments of counsel, the Court granted Defendant’s Motion for Summary Judgment as to all claims.
