Summary:
A large Southeastern law firm that handled mortgage foreclosure proceedings helped with a routine foreclosure on a property whose mortgage had not been paid. The plaintiff, the individual who failed to make the payments, responded to the foreclosure by filing a lawsuit against the law firm and one of its former attorneys , alleging that the law firm had committed fraud, among other things.
The firm came to CSH defense attorney Melody Jolly to respond to the suit, and round after round of amendments the plaintiff kept filing to his lawsuit. Ms. Jolly pointed out that, even after the amendments were made, the lawsuit was based on vague allegations rather than fact or law. The court agreed and dismissed the suit against Ms. Jolly’s clients entirely.
Result/Implications:
CSH attorney Melody Jolly put a stop to the plaintiff’s multiple rounds of fruitless complaints by filing and winning a motion to dismiss, saving her clients from any further involvement in a meritless suit.
