When a plaintiff threatened to file a bad faith lawsuit against her client, CSH attorney Burkhart was able to stop the suit before it started by negotiating a settlement.
The plaintiff was an individual with an insurance policy from a UIM insurance company represented by CSH. The plaintiff accused the company of conspiring with another insurance company, alleging that the companies had conspired not to pay the plaintiff under the policy but instead force him into arbitration, a process that can be lengthy and costly. On the basis of those allegations, the plaintiff was planning to file a bad faith lawsuit against CSH’s client. CSH attorney Susan Burkhart met with the plaintiff’s attorney and was able to negotiate a settlement of the claim, avoiding entirely the filing of a bad faith lawsuit against her client.
Through skillful negotiation, CSH attorney Burkhart was able to help her client avoid a bad faith lawsuit before it even began.
