STEPHANIE GASTON POLEY (Raleigh) successfully represented a car rental company (“Rental Company”) in a motor vehicle negligence case. Defendant driver, represented by separate counsel, was allegedly operating the rental vehicle at the time of the accident. In his complaint, Plaintiff alleged that Rental Company owned the vehicle operated by the defendant driver, but Plaintiff failed to allege any independent acts of negligence on the part of Rental Company. A Motion for Summary Judgment was filed pursuant to 49 U.S.C. 30106 on behalf of Rental Company. The morning of the Summary Judgment hearing, Plaintiff took a dismissal without prejudice of his claims against Rental Company. The remaining Defendants later settled the case and obtained a global release and dismissal with prejudice of all Defendants, including Rental Company.
