Mica Nguyen Worthy (Charlotte) represented buyer who was based out of South Korea and purchased computer chips from a supplier in North Carolina. The parts delivered were defective and non-conforming to the contract specifications, but the supplier refused to refund the purchase price citing provisions in their online “terms and conditions.” The buyer attempted international arbitration in South Korea but the tribunal did not accept jurisdiction, so the buyer retained our firm for legal analysis of the law applicable to the international sale and negotiations with the supplier. We were able to negotiate a pre-suit resolution the case with favorable terms for our client.
