DAN HARTZOG (Raleigh) and a former Cranfill Sumner attorney obtained a summary judgment in favor of the defendants, a police department and two police officers, in a wrongful death action where the plaintiff’s decedent’s vehicle collided with a patrol car involved in a vehicular pursuit. The defendants argued, and the court agreed, that the appropriate standard is gross negligence and that the evidence failed to establish gross negligence on the part of the defendants as a matter of law.
