Town filed suit against Melody Jolly‘s (Wilmington) client, Architect, and the general contractor for damages arising from the design and construction of a municipal project, specifically relating to the storm water retention system. In addition to filing suit in state court, Town contemporaneously filed a demand for arbitration with AAA, seeking $1,000,000.00 in damages for breach of contract and professional negligence, against the general contractor and Architect. We brought in our specialty subcontractor as a third party to both actions, and after multiple mediations, in November 2013, a confidential settlement was reached, with no payment required by our client. The Town settled out separately with the general contractor. (2014 – confidential settlement so no parties are disclosed)
