Plaintiff claimed to have suffered a torn head of the biceps tendon as a result of negligent physical therapy in which it was claimed that the therapist inappropriately manipulated the Plaintiff’s arm, necessitating surgical intervention.  Plaintiff’s treating surgeon testified that based on the plaintiff’s description of the incident and his surgical findings, the incident may have been the cause of the injury and subsequent surgery.

John Ong was able to obtain a directed verdict following the close of the plaintiff’s evidence based on the lack of specific testimony regarding the probability that the incident was the cause of the injury.
